P17-million tax evasion case vs Napoles’ daughter junked

(Eagle News) — The Court of Tax Appeals has junked the P17-million tax evasion case against the daughter of alleged pork barrel scam mastermind Janet Lim-Napoles.

A report said the third division, through a Dec. 6 resolution, dismissed the case against Jeane Catherine Napoles for “insufficiency of evidence.”

The younger Napoles had argued that she was “just a student with no taxable income” and as such shouldn’t be told to pay income taxes from 2011 to 2012 for her alleged ownership of a P54.73 million Ritz Carlton condominium unit in Los Angeles, California, and P1.49-million farm lots in Pangasinan, the report said.

The report said she added that she had only received the “property as a gift.”

“The prosecution failed to prove that there is any income tax due from accused, creating reasonable doubt as to the guilt of accused,” the report quoted the resolution as saying.
