Trillanes asks Makati court to junk DOJ plea for issuance of alias warrant, HDO vs him

(Eagle News)–Senator Antonio Trillanes IV on Monday, Sept. 10, asked a Makati court to junk a Department of Justice motion seeking for an alias warrant and a hold departure order against him.

In seeking for the dismissal of the motion filed before Branch 148 of the Makati Regional Trial Court, Trillanes said the court no longer has jurisdiction over him  since the case filed against him in connection with the Oakwood Mutiny in 2003 “had long been terminated and dismissed.”

The DOJ’s contention is that the case’s earlier dismissal due to the grant of amnesty to Trillanes no longer holds  following the issuance of Proclamation No. 572 that declared the amnesty void ab initio in the first place.

“Hence, the denial of the prosecution’s very urgent ex-parte omnibus motion dated 04 September 2018 for lack of jurisdiction and/or lack of legal and factual bases, is clearly proper and in order,” Trillanes said.

Judge Andres Soriano set the motion for hearing on Thursday, September 13.

Makati RTC Branch 150  will hear a similar  motion the following day.

It was the DOJ that filed this motion in the sala of Judge Elmo Alameda, where a case this time of rebellion had  been filed against Trillanes in connection with the Peninsula Manila siege in 2007.
