Makati RTC Branch 150 to hear on Friday Trillanes’ appeal of court order allowing issuance of warrant, HDO vs him

(Eagle News) — The Makati City Regional Trial Court Branch 150 has scheduled for hearing Senator Antonio Trillanes IV’s appeal of its decision to allow the issuance of an alias warrant and a hold departure order against him.

Judge Elmo Alameda set the hearing for Friday, Oct. 12.

In his appeal of the Sept. 25 order that essentially revived the rebellion charges against the senator, Trillanes said the prosecution’s argument he did not file an application for amnesty was “mere innuendo.”

Proclamation No. 572 declared the amnesty granted to Trillanes for the rebellion and coup d’etat charges filed against him in connection with the Oakwood mutiny and Peninsula Manila incidents in 2003 and 2007, respectively, void ab initio after ruling he did not file an application for the amnesty in the first place.

Apart from that argument, the proclamation noted Trillanes’ alleged failure to make an express admission of guilt and to recant his statements.

Makati RTC Branch 148, where the coup d’etat charges are pending, has not issued an alias warrant against Trillanes just yet, and instead allowed both parties to submit their respective pleadings first.
