(Eagle News) — The camp of Australian nun Patricia Fox said it would question the Bureau of Immigration’s decision to forfeit her missionary visa, and order for her to leave.
In a television interview, Jobert Pahilga, Fox’s counsel, said they would first file a motion for reconsideration with the BI.
If the BI denies their motion, he said they would elevate the issue to the Court of Appeals, and then to the Supreme Court if needed.
“We can go to the CA or the SC to question because where there is abuse of discretion apparently on the part of the Immigration because they themselves did not follow the earlier April 17 order of the BI commissioner Morente giving Sister Patricia Fox ten days to file her counter affidavit,” Pahilga said.
He added the bureau should have also held a hearing prior to forfeiting Fox’s visa as part of due process.
According to Pahilga, they have not yet received a copy of the BI’s order.
