BIR sues gold trader for “willful failure” to pay taxes

(Eagle News) — The Bureau of Internal Revenue has charged a gold trader for his alleged willful failure to pay taxes for five years.

In a statement on Thursday, the BIR said the five criminal complaints were filed against Angelito Ocampo Dela Pena after he failed to pay  P1,732,808,956.22 in tax deficiencies from 2005 to 2009.

This was after the Bangko Sentral ng Pilipinas, with whom Dela Pena was exclusively engaged in the buying and selling of gold, issued a certification showing that the gold trader indeed transacted with them in those five years.

The certification was issued upon the request of by the BIR.

According to the BIR, notices and formal letters of demand, among others, were sent to Dela Pena, “but the respondent failed to either pay or protest and submit relevant supporting documents to either substantiate his claims or to refute said assessments, hence making the said assessments final, executory and demandable.”

“The respondent’s obstinate failure and continued refusal to pay his long overdue deficiency taxes, despite repeated demands, constitute willful failure to pay the taxes due the government,” the BIR said.

The BIR said the complaints filed against the gold trader were the 140th to 144th filed under the government’s Run After Tax Evaders program.
