(Eagle News) — The Court of Appeals has affirmed its earlier decision rejecting the enforcement of a Hawaii court’s judgment that awarded almost $2 billion in damages to martial law claimants.
In its ruling, the CA’s Former Twelfth Division said there was “no new or substantial matter” raised by petitioners former Commission on Human Rights chair Etta Rosales, Hilda Narciso, Priscilla Mijares, Mariano Dimaranan, and director Joel Lamangan that warrants a reversal of its July 7, 2017 decision.
In that decision, the appellate court upheld a ruling issued by the Makati Regional Trial Court that rejected their plea for the Hawaii court ruling to be recognized.
The Hawaii court ruling stems from a class suit filed by around 10,000 martial law claimants.
In its July 2017 decision, the CA said that there was “no common question of law and fact between the claimants,” and as such, a class suit should not have been filed in the first place.
