(Eagle News) — The Office of the Solicitor General has asked the Department of Justice to deny businessman Peter Lim’s motion seeking for the reinstatement of the Department of Justice’s panel of prosecutors’ resolution that dismissed the drug complaint against him and several others.
The OSG, which represents the Philippine National Police’s Criminal Investigation and Detection Group, made the request in a comment to Lim’s motion for reconsideration of Justice Secretary Vitaliano Aguirre’s order “vacating” the March 19 order approved by Prosecutor General Claro Arellano.
According to the OSG, Aguirre “had every reason to believe that the dismissal of the complaint would cause a probable miscarriage of justice to the entire People of the Philippines.”
It noted the admission of Kerwin Espinosa, Lim’s co-accused, that he was a drug distributor in a Senate hearing in 2016.
In a resolution in December 2017, the panel of prosecutors cited the alleged inconsistencies in the statements of the state’s sole witness, Marcelo Adorco, in dismissing the drug complaints against Lim, Peter Co, Marcelo Adorco, Max Miro, Lovely Adam Impal, Ruel Mangalindan and Jaime Jun Pepito and individuals identified only by their aliases Jeremy aka “Amang,” Ricky,”Warren,”Tupie,”Jojo,”“Yawa,” Lapi,” Royroy,”Marlon,” Bay,”John Doe,” “Peter Doe” and “Robert Doe.”
Aguirre issued the resolution in March 2018, days after news broke about the dismissal of the drug complaints.
Aguirre resigned afterwards.
