Pay rules for 25 February 2016, a special non-working holiday

The Department of Labor and Employment has released Advisory No. 08 Series of 2015 to guide employers in issuing payment of wages, and inform workers of their privileges for the special (non-working) holiday on 25 February 2016.

This is in observance of the 30th Edsa People Power Revolution.

The Labor Advisory keeps in step with the Proclamation No. 1071 issued by President Benigno S. Aquino III on 8 July 2015.

“The rules for pay on special days shall apply on 25 February 2016 throughout the country,” Secretary Rosalinda Baldoz said.

The pay rules mandates that if the employee did not work, the “no work, no pay” principle shall apply, unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on special day.

For work done during the special day, the workers shall be paid an additional 30 percent of their daily rate on the first eight hours of work. The ‘Daily rate x 130% plus COLA’ scheme will be observed.

For work done in excess of eight hours (overtime work), the workers will be paid an additional 30 percent of their hourly rate on said day. The computation will be: hourly rate of the basic daily wage x 130% x 130% x number of hours worked.

For work done during a special day that also falls on the workers’ rest day, they shall be paid an additional 50 percent of their daily rate on the first eight hours of work, thus, the ‘Daily rate x 150% + COLA’ computation will apply.

For work done in excess of eight hours (overtime work) during a special day that also falls on the workers’ rest day, they shall be paid an additional 30 percent of their hourly rate on said day, or a computation of ‘hourly rate of the basic daily wage x 150% x 130% x number of hours worked’.

“We are issuing this Advisory to guide as early as possible our employers, especially in the private sector, and update our workers of the benefits due them. Keeping our workers rightly informed is also one way of empowering them,” said Baldoz.

The Secretary added that the commemoration also brings to the fore the essence of the workers’ empowerment, which is one of the lasting legacies of the Edsa People Power Revolution, and nurtured by the administration through its various labor reforms now benefitting the industry.

President Benigno S. Aquino III issued Proclamation No. 1071 declaring Thursday, 25 February 2016 as a Special (Non-Working) Holiday throughout the country to mark the 30th Anniversary of the Edsa People Power Revolution.
