(Eagle News)—-The Supreme Court has junked Peter Lim’s bid for the Department of Justice to be stopped from reinvestigating the drug charges filed against him but which have been dismissed.
“The Court resolves to dismiss the petition for failure to show any grave abuse of discretion in rendering the challenged order and resolution which, on the contrary, appear to be in accord with the facts and applicable law and jurisprudence,” the one-page notice from the High Court said.
The petition that sought for a temporary restraining order was filed by Lim after then-Justice Secretary Vitaliano Aguirre vacated a July 23 order issued by a first panel of DOJ prosecutors that dismissed the drug charges against him, and ordered a new panel to conduct a new probe.
Lim had argued a new probe would violate his right to due process, among others.
The second panel, however, found probable cause to charge him, Kerwin Espinosa and several others in court for conspiracy to commit illegal drug trading.
