SC asked to nullify Sereno appointment if she fails to submit “missing” SALNs, show proof she passed psych exam

(Eagle News) — A lawyer has asked the Supreme Court to compel Chief Justice Maria Lourdes Sereno to submit her allegedly missing Statements of Assets, Liabilities and Net Worth and show proof she passed the psychological exam when she was applying for the post.

According to Romeo Igot, if Sereno failed to do this, the SC should declare void her appointment as top magistrate.

“…With all due respect, to allow a situation like this to continue, despite clear evidence of lack or failure of compliance with the requirements for the position, would be allowing a tribunal…to unlawfully neglect the performance of an act which the law specifically enjoins as a duty resulting from an office or station…” Igot said in a petition filed on Friday.

Igot’s petition comes after the SC junked Oliver Lozano’s petition seeking to have Sereno’s appointment as top magistrate nullified.

The High Court had cited lack of merit in dismissing that petition.

Sereno is also facing a quo warranto petition filed by Solicitor General Jose Calida.

This was apart from the impeachment complaint filed by lawyer Larry Gadon against her.

Acting on the complaint, the House justice panel only recently found probable cause to impeach Sereno.
