Second court where DOJ lodged motion vs Trillanes won’t issue warrant vs him just yet

(Eagle News) — The Makati court where the Department of Justice lodged a second motion for an alias warrant and hold departure order against Senator Antonio Trillanes IV will not issue the warrant just yet.

Lawyer Diosfa Valencia, the Clerk of Court of the Makati Regional Trial Court’s Branch 150, said they have to retrieve case records first.

Trillanes, who played a prominent role in the Oakwood mutiny and Peninsula Manila siege in 2003 and 2007, respectively, was charged before the court.

The DOJ filed the motion there after filing a similar one  before Branch 148 of the Makati RTC, where  Trillanes was also charged with separate raps.

Trillanes contends the cases against him in connection with the incidents in 2003 and 2007 have already been dismissed, but for the DOJ, they are still pending following the issuance of Proclamation No. 572.

The proclamation declares the amnesty granted to Trillanes as void ab initio, citing as bases his alleged failure to file an official form of application for the same, and a certification from the Armed Forces of the Philippines that said a copy of his application was not available.

The proclamation also cited Trillanes’ alleged failure to make an express admission of his guilt.

According to the DOJ, the dismissal of Trillanes’ cases were, after all, “anchored on” the amnesty granted to him.
