Sereno camp “seriously considering” filing MR of en banc decision nullifying her appointment as Chief Justice

(Eagle News) — Maria Lourdes Sereno is “seriously considering” filing a motion for reconsideration of the decision of the Supreme Court to nullify her appointment as Chief Justice, one of her spokespersons said on Friday, May 11.

In a television interview, Josa Deinla said this was considering the “fight was a close call,” with eight justices favoring the quo warranto petition filed by Solicitor General Jose Calida, and six voting against it.

“And we know for a fact the SC has changed its mind in high-profile cases,” she said.

She also questioned the statement of the SC that the order for Sereno to vacate the post was “immediately executory,” noting that it was as if her right to resort to a recourse was being removed.

“Sa pagprapractise ng batas ang isang desisyon ay di pa final and executory hanggang may nalalabi pang apela,” she said.

“Yung matagal na naming ikinatatakot ay yung lilikha ito ng pagkasira sa kasarinlan ng hudikatura sapagkat napatunayan na natin na may sandata na hawak ang Solicitor General. Ang sandata na ito ay maaring gamitin bilang panggigipit sa mga hukom na tinuturing nilang balakid, kaaway,” she added.
