QUEZON City, Philippines (Eagle News) — Solicitor General Jose Calida asked the Supreme Court to allow the Muntinlupa Regional Trial Court to resolve the illegal drug case filed against Senator Leila De Lima.
During the oral arguments, Calida told the high court magistrates that the motion to dismiss initially filed by De Lima was lodged in the sala of Branch 204 Judge Juanita Guerrero. It is the Muntinlupa lower court, particularly Judge Guerrero, who should be the one to resolve the case, he said.
Calida further argued that there is no longer any need to quash the warrant of arrest against Senator Leila De Lima as she is already in the custody of the Philippine National Police.
It was Guerrero who issued the warrant for De Lima’s arrest in February for illegal drug trading.
Authorities argues she particularly violated Section 5 (sale) in relation to section 3 (trading), section 26 (b) and Section 28 of Republic Act 9165 or the Comprehensive Dangerous Drugs Act of 2002.
